O'Neill v BC

Sam O'Neill was denied access to medical assistance in dying at St Paul's Hospital in 2023. Her family and Dying With Dignity Canada have challenged the provincial government's agreement with faith-based healthcare facilities as violating Sam's Charter rights.

The BCHA was granted leave to intervene at the Supreme Court of BC to bring arguments about the government's duty of religious neutrality and its applicability to publicly funded service-providers.

The BCHA is being represented by Wes McMillan and Danielle Wierenga of Allen / McMillan Litigation Counsel.
